3 Benefits Of Having A Notary Witness Your Documents

A notary is a person who witnesses signatures on documents for a living. They act as a neutral, outside third party with no interests in the transactions they're witnesses to, but who confirm identities and then actually witness signatures being put to documents.

In some instances the services of a notary may be legally required, but in other cases you may want to consider hiring such a person on your own. Consider some benefits of having such a person witness your signature or the signature of another party on your documents.

1. The transaction is more likely to hold up in court

Consider as an example buying a used car. Once the old owners sign over the paperwork and title to you, they cannot make a claim that they never signed the paperwork and then report the car as having been stolen. With a notary there to witness their signatures, they would have little means of claiming that they never signed the documents. This can be a protection for you in any situation where the other party may later claim that they did not sign the documents in question.

2. Documents are less likely to be altered after a notary witnesses signatures

In many cases a notary will keep a copy of the documents that he or she witnesses being signed, for their own records. This protects everyone who was part of the transaction from having those documents altered at a later date.

Consider the example of buying a used car again. Suppose you are the seller and you made notes as to the condition of the car and repairs it needed. The buyer would have little means to return to you later and say that you never informed him or her of those repairs, trying to sue you. The notary would have a copy of the information you gave them and you could use that as proof.

3. A notary can check necessary identifications

You may not be able to tell a forged driver's license from the real thing or may not know the proper identification to ask for when handling certain transactions. However a notary will have no hesitation about asking for various forms of identification and will be more skilled at determining if that identification is valid. This can ensure that the persons signing the documents are the same persons named on the documents, and can protect you from buying stolen property or from having those signatures questioned later in court.
