Things That Can Cause Your Child's Teacher To Falsely Claim Abuse To Your Child

by Gene Vasquez

If your teacher thinks your child is being abused and he or she is not, you will need to hire a lawyer to help you. For example, your child may have powdered drink stains on their arm that look like a bruise, and your teacher thinks it is. You may get a visit from Child Protective Services very quickly, and this can be a very scary time for both you and your child.

Hire a Lawyer

The first thing you need to do is to hire a criminal defense lawyer (contact a firm such at Coley Hennessy Cassis Ewasko Lawyers to see if they can help) to represent you. They can immediately talk with the prosecutor and explain the situation to them. In some cases, like with the powdered drink stain, they may drop the charges. This may be difficult to do, and the best strategy is to counter attack the allegations, and show proof that you were wrongfully accused.

Accidental Injury

In many cases, if there are bruises or cuts found on a child it is due to an accident. For example, they may fall on their bike, fall while running, accidentally getting cut at home, etc. The only time a court will look at this as child abuse if the accident was due to carelessness or recklessness. For example, if you leave your sleeping baby in a hot car when you didn't mean to. This is considered negligence to the court system.

Your hot water heater may be set too high and you child's skin turns red after they get out of the bath. This redness may not go away quickly, and your child's teacher may think your child is being burned. In a case like this, the attorney will likely come to your home and bring a plumber with him to check the temperature of the water.

Child Caused Injury

If your child harms himself, such as in a fight at school, the parents may be accused of doing it. There are also medical conditions that can make it look like a child is being abused, such as hemophilia and leukemia.  The attorney needs to be able to prove this to the judge. He may contact the school if the child was injured there. If the injury was at home, the attorney may interview people, such as neighbors or other people in the household.

Animals Caused Injury

If you have a dog, they can easily jump up on your child and knock them down if it is large. It could easily nip at your child causing a bruise or a cut. If you have a cat, it is common for them to put scratches on your child. This could easily be explained and sometimes thrown out of court before a trial even happens. The attorney will likely come to your home to see the animal before he or she goes to the judge.

Even though being accused of child abuse is very difficult to understand, and you may feel like lashing out, it is not as bad as you think. If you look at it from the teacher's eyes, he or she is simply trying to protect your child, as any adult should do in cases like this.
